Terms Of Service

The following conditions apply to the use of the GotCashBack.com service.

These Terms of Service ("Terms") govern your access to and use of the GotCashback.com website, its regional editions, the GotCashback Developers API, and all related content, features, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service. Your agreement with us becomes effective immediately upon your first use of the Service.

1. About the Service

GotCashback.com is a comparison service that aggregates and displays cashback rates, sign-up bonuses, and gift card discounts offered by third-party cashback portals and merchants. We are not a cashback portal ourselves and do not pay cashback. All transactions occur between you and the relevant third-party portal or merchant under their own terms.

2. Intellectual Property

The content, organization, graphics, design, compilation, and other materials available through the Service (the "Content") are protected under applicable copyright, trademark, and other intellectual property laws. Except as expressly permitted in these Terms, you do not acquire any ownership rights in the Content by accessing or using the Service. The publication of information on the Service does not constitute a waiver of any rights in that information.

3. Limited License

We grant you a non-exclusive, non-transferable, revocable license to:

(a) access and use the Service in accordance with these Terms;

(b) use the Service and its Content for personal, non-commercial purposes, including comparing cashback rates and gift card discounts to inform your own purchasing decisions; and

(c) print or save discrete portions of the Content for personal reference, provided that copyright and attribution notices are preserved.

4. Restrictions on Use

You may not, except as expressly permitted under Section 5 (AI and Automated Access) or under a separate written agreement with us:

(a) copy, scrape, or extract Content from the Service for the purpose of creating a competing cashback or gift card comparison service, database, or dataset, whether offered free of charge or for commercial distribution by sale, license, lease, rental, subscription, or any other mechanism;

(b) systematically download, harvest, or replicate the Service's database in whole or in substantial part;

(d) use the Service in any manner that imposes an unreasonable load on our infrastructure, circumvents technical access controls or rate limits, or interferes with the normal operation of the Service; or

(e) use the Service for any unlawful purpose or in violation of any applicable law or regulation.

5. AI and Automated Access

We welcome access to the Service by AI assistants, search engines, answer engines, and other automated agents ("Automated Systems") for the purpose of retrieving current information from the Service in order to answer end-user questions, subject to the following conditions:

5.1 Attribution and Linking

Any response, summary, or other output produced by an Automated System that incorporates Content from the Service must (a) identify GotCashback.com as the source of that Content, and (b) where the output medium permits hyperlinks, include a working link to the specific page of the Service from which the Content was obtained.

5.2 Freshness of Data

Cashback rates, sign-up bonuses, and gift card discounts displayed on the Service change frequently. Automated Systems should retrieve Content at or near the time of the end user's request rather than relying on cached or previously stored copies, and must not present outdated rates as current.

5.3 Responsive Use, Not Replication

Automated Systems may quote, summarize, or paraphrase Content in direct response to end-user queries. Automated Systems may not systematically copy, store, or redistribute the Service's database, in whole or in substantial part, and may not use Content from the Service to train, fine-tune, or otherwise develop systems designed to reproduce the Service's dataset or to operate a competing comparison service.

5.4 Technical Compliance

Automated Systems must honor the directives published in our robots.txt file and any rate limits or other technical access controls we impose. Operators requiring high-volume or structured programmatic access should use the GotCashback Developers API, which is governed by its own terms.

5.5 Identification

Automated Systems should identify themselves accurately via user-agent strings or equivalent mechanisms and must not misrepresent themselves as human visitors or as other agents.

5.6 Reservation and Revocation

We reserve the right to restrict, throttle, or terminate access by any Automated System that violates these conditions, and to modify this Section at any time by publishing updated Terms. Access permitted under this Section is a revocable license, not a waiver of our rights under Section 4 or applicable law.

6. Accuracy of Information

We strive to keep the information on the Service accurate and up to date, but cashback rates, bonuses, and discounts are set by third parties and change frequently. We do not guarantee the accuracy, completeness, or timeliness of any information on the Service, and we are not liable for decisions made in reliance on it. Always confirm the current rate and terms on the relevant cashback portal or merchant site before completing a transaction.

7. Third-Party Sites and Services

The Service contains links to third-party websites, including cashback portals and merchants. We do not control and are not responsible for the content, policies, or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their respective terms and privacy policies. Some links on the Service are affiliate links, and we may receive compensation when you click them or make purchases through them.

8. Accounts and Security

If you register for an account, you are responsible for maintaining the confidentiality and security of your credentials and for all activity that occurs under your account. Accounts are not transferable. You agree to notify us promptly of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOTCASHBACK.COM AND ITS OWNERS, OPERATORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

11. Indemnification

You agree to indemnify and hold harmless GotCashback.com and its owners, operators, and affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.

12. Changes to the Service and These Terms

We may modify or discontinue any part of the Service at any time. We may also revise these Terms from time to time by posting an updated version with a new effective date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. Sections 2, 4, 5.6, 6, 9, 10, 11, and 14 survive termination.

14. Governing Law

These Terms are governed by the laws of State of Wisconsin, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts located in Milwaukee, WI.
